AN ORDINANCE TO AMEND ORDINANCE #5 OF 1989, THE MEADOWOOD TRAILS SITE CONDOMINIUM PLANNED UNIT DEVELOPMENT PROJECT

CASCADE CHARTER TOWNSHIP ORDAINS:

Section 1. Amendments to the Meadowood Trails PUD Ordinance

The following described property shall be amended into the Meadowood Trails Planned Unit Development and be attached to, and become part of, Unit 12;

That part of the SE ¼, Section 17, T6N, R10W, Cascade Township, Kent County, Michigan, described as: BEGINNING at the NW corner of said Unit 12; thence N 14 degrees 58’00"W 50.00 feet along the Easterly line of Meadowood Trails (private drive): thence N 75 degrees 02’00"E 135.02 feet; thence S 14 degrees 58’00"E 50.00 feet; thence S 75 degrees 02’00"W 135.02 feet along the Northerly line of Unit 12 to the place of beginning.

No construction shall take place within the area that is added to Unit 12. This restriction shall also be conveyed on the property deed.

The inclusion of this additional property into the development does not allow the creation of any additional condominium units.

Section 2. Effective Date

This PUD Ordinance amendment shall become effective upon publication in the Grand Rapids Press, a newspaper of general circulation within Cascade Charter Township.

Section 3. Effect

The Cascade Charter Township Zoning Ordinance, as amended, and the remainder of Ordinance #5 of 1989, except as otherwise expressly amended herein, shall remain in full force and effect.

The foregoing Ordinance amendment was offered by Board Member Van Strien, supported by Board Member Johnson. The roll call vote being as follows:

YEAS: Carpenter, Goodyke, Johnson, Kleinheksel, Timmons, Van Strien

NAYS: None

ABSENT: Julien

ORDINANCE DECLARED ADOPTED.
